  • Communal influence on the Tort of Negligence in the UK and Canada

Issue: The extent to which higher order law have informed judicial decisions in negligence cases, thereby developing tort doctrine that serves community values in the UK and Canada. Theme: Law formally expresses societal values in western democracies. Community considerations in common law judgments of private disputes illustrate the extent of communal influence on private law. Drawing on communitarianism, where community is a source of principles of justice, this project seeks to understand the extent of society’s impact on resolving interpersonal disputes in negligence law.
